DEPRODATA PROPRIETARY SOFTWARE FRAMEWORK LICENSE

This agreement provides the general proprietary licensing framework for software, runtime components, packaged applications, and related materials distributed under the DEPRODATA umbrella, including but not limited to the following names and designations:
- DEPRODATA Framework
- DEPRODATA Suite
- DEPRODATA Ecosystem
- DEPRODATA Launcher
- DEPRODATA Applications (DDAs)
- DEPRODATA Application Packages (.dpa)
- DEPRODATA portable runtime components
- Related documentation, templates, examples, notices, and bundled materials
By downloading, installing, copying, accessing, or using any covered DEPRODATA artifact, you accept the terms of this agreement.
1. Nature of This License
This document is a general proprietary umbrella license for the DEPRODATA Framework, Suite, Ecosystem, Launcher, and DDAs.
It is intended to define the default legal framework for DEPRODATA software artifacts unless a separate written agreement or an artifact-specific legal notice expressly states otherwise.
This software is proprietary and is licensed, not sold.
2. Ownership and Intellectual Property
All intellectual property rights, title, and interest in DEPRODATA software and related materials remain the exclusive property of Diego Espinosa and/or DEPRODATA, except where a separate written agreement explicitly states a different ownership allocation for a specific artifact.
This includes, without limitation:
- source code
- binaries
- launcher components
- DDAs
- packaged distributions
- licensing systems
- documentation
- visual identity and branding
- templates, examples, and auxiliary materials
3. Scope of License
Subject to this agreement, you are granted a limited, non-exclusive, non-transferable, non-sublicensable license to use DEPRODATA software in binary, object-code, packaged, or otherwise distributed form for lawful internal, academic, technical, evaluation, or commercial purposes, depending on:
- the specific artifact,
- its distribution status,
- its license category,
- and any valid artifact-specific notice or signed license associated with it.
Some DEPRODATA artifacts may be distributed free of charge. Free-of-charge access does not make the software open source and does not transfer ownership, redistribution rights, sublicensing rights, or rights to derivative works.
4. Artifact Classes
DEPRODATA artifacts may be distributed in different categories, including:
- public artifacts, which may be used without a separate license file;
- signed artifacts, which require a valid signed license file (.lic) issued for a specific artifact and, where applicable, a specific machine, user, duration, or license category; and
- specially governed artifacts, which may additionally reference a notice, supplement, commissioning statement, sponsorship notice, or separate written agreement.
If a signed artifact is distributed without a valid license, with an expired license, with a machine-mismatched license, or with a tampered license, the software may refuse to run.
5. Notices, Supplements, and Artifact-Specific Terms
Individual DEPRODATA artifacts may be accompanied by one or more of the following:
- a README
- a NOTICE file
- a sponsorship or attribution notice
- a commissioning statement
- a funding statement
- an artifact-specific supplement
- a separate contract or written agreement
Such materials may clarify:
- artifact identity
- authorship
- sponsorship
- commissioning context
- deployment model
- citation guidance
- license category
- machine-binding rules
- duration or activation constraints
Unless expressly stated otherwise in a separate written agreement, such artifact-specific notices supplement this framework and do not replace it.
6. Sponsored, Commissioned, or Third-Party Contexts
Some DEPRODATA Applications (DDAs) or related artifacts may be:
- self-funded,
- independently developed,
- sponsored,
- commissioned,
- co-developed,
- institutionally supported,
- or delivered within academic, industrial, governmental, or employment contexts.
The existence of sponsorship, commissioning, institutional support, or third-party context does not by itself transfer ownership or create open-source rights.
If a specific artifact is subject to different ownership, usage, attribution, or distribution conditions, those conditions must be stated in a separate written agreement or artifact-specific notice.
7. Restrictions
Except where mandatory law expressly permits otherwise, you may not:
- copy, redistribute, publish, resell, rent, lease, sublicense, or commercially exploit DEPRODATA software as a standalone product;
- modify, adapt, translate, create derivative works from, or merge the software into another product or system;
- reverse engineer, decompile, disassemble, decode, or otherwise attempt to derive source code, models, private logic, keys, or protected implementation details;
- remove, alter, or obscure copyright notices, trademarks, authorship information, attribution notices, or technical protection mechanisms;
- bypass, disable, tamper with, or interfere with licensing, signature validation, activation, packaging, runtime checks, or access-control mechanisms;
- distribute or expose private keys, signing material, internal issuance tooling, or confidential licensing artifacts;
- misrepresent the authorship, legal status, provenance, or sponsorship of a DEPRODATA artifact.
8. Distribution
You may distribute DEPRODATA software only if you have explicit written permission from the software provider or other rights holder authorized to grant such permission.
Unless such permission is granted, end users may use distributed binaries and packages only under this license and may not repackage or redistribute them.
9. Documentation and Citation
Where the DEPRODATA Launcher or a DEPRODATA Application (DDA) provides citation guidance, users are encouraged to cite the corresponding software in scientific, technical, or academic work.
Citation guidance does not grant any license beyond the terms of this agreement.
10. Support and Updates
Support, maintenance, updates, access to new DDAs, and issuance of signed licenses are provided at the sole discretion of the software provider and may depend on:
- artifact category,
- distribution status,
- license type,
- sponsorship status,
- or separate commercial or institutional terms.
11. No Warranty
THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RESULTS.
The software provider does not warrant that the software will be uninterrupted, error-free, suitable for a specific workflow, or compatible with every environment.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, BUSINESS, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. Termination
This license terminates automatically if you breach its terms. Upon termination, you must stop using the software and delete or destroy all copies under your control, unless continued retention is required by law.
14. Separate Agreements
If you have entered into a separate written agreement, order, academic arrangement, sponsorship agreement, commissioning agreement, employment agreement, or commercial contract with the software provider or an authorized rights holder, that agreement may supplement or override parts of this license for the covered artifact.
